What is Product Liability?

There are two types of product liability cases:

  • Defective products: a product can be defective due to a failure in design or manufacturing. An example of a design defect is a snow blower manufacturer that decides to make wheels out of plastic rather than metal. While the plastic wheels may be cheaper, if they explode when consumers inflate the tires, this is a design defect
  • Dangerous products: When a product is inherently dangerous, consumers have a right to be warned. For example, if a prescription drug may cause death when used in combination with other drugs, consumers need to be adequately warned.
